Foreclosure

Facing a foreclosure can be devastating. If the foreclosure process moves forward, you will lose your home. This is why it’s important that you know and understand your legal rights when it comes to fighting foreclosure before it is too late.

Kain + Henehan are bankruptcy lawyers located in the St. Cloud and Twin Cities area, providing our services to Minnesotans. We understand the concern that accompanies financial troubles and possible foreclosure.

chapter 13 bankruptcy has the ability to permanently stop foreclosures or evictions. It can put you on a path to getting current on your mortgage payments. It allows for you to make payments over 3-5 years to your mortgage holder in order to get up to date.

A chapter 13 bankruptcy allows a flexible payment term that you wouldn’t be able to get working with your mortgage lender. We will go over your mortgage arrears and calculate what chapter 13 payments will look like to get you back on track and staying in your home.

Our process makes it easier to navigate a chapter 13 bankruptcy to avoid foreclosure and allow you to keep your home.

What is Foreclosure?

Foreclosure is a process in which a lender reclaims a mortgaged home or property from the borrower who has failed to make payments on time or has defaulted on their mortgage. The lender takes ownership of the property and can either keep it, rent it out, or sell it, in order to recoup some of the money that was lent to the borrower.

When a borrower fails to meet their obligations under the loan agreement, the lender initiates legal action to foreclose on the property and take back ownership of it. This process can have serious implications for borrowers who have invested in their own homes and may not be able to finance another one. Foreclosure obviously can also have an emotional toll as well.

During the foreclosure process, the homeowner may be able to negotiate with the lender in order to keep their home, or they may need to surrender ownership of it.

It’s important to note that if you’re facing foreclosure it’s important to seek help right away as failing to do so could result in losing your home. Part of seeking help is to talk with the lawyers of Kain + Henehan to see if chapter 13 is a good option.

Can You Avoid Foreclosure?

Foreclosure is a difficult process for both the borrower and the lender, but it is possible to avoid foreclosure. One way is to file bankruptcy. A chapter 13 bankruptcy has the ability to permanently stop foreclosures or evictions.
